Abstract

This paper examined the concept of proof of possession as a means of ownership in Nigeria, with a focus on the legal requirements, challenges, and implications of relying on possession as a means of proof of ownership. The aim of this paper was to critically evaluate the legal framework governing possession as a means of proof of ownership in Nigeria, identify the challenges and limitations of relying on possession. The paper employed a doctrinal research methodology, analysing relevant statutes, case laws, and academic literature to provide a comprehensive understanding of the concept of possession as a means of proof of ownership in Nigeria. The paper recommended that the Nigerian government should clarify the legal requirements for establishing possession as a means of proof of ownership, providing clear guidelines on what constitutes possession and the types of acts that demonstrate possession. Finally, the paper recommended that the Land Use Act should be reviewed to provide more clarity and certainty in proving ownership through possession. This can help to reduce disputes over land ownership and promote secure land ownership. By providing clarity and certainty in the legal framework governing possession, Nigeria can promote secure land ownership, reduce disputes over land ownership, and improve the overall efficiency of land transactions. Ultimately, this study contributes to the ongoing debate on land ownership and possession in Nigeria, providing valuable insights and recommendations for policymakers, lawyers, and other stakeholders.
